Platform overview

This document is an electronic record published in accordance with the Information Technology Act, 2000 and the rules thereunder, and is generated by a computer system. It does not require physical or digital signatures.

The website clozzet.in and the mobile application Clozzet (together, the "Platform") are owned and managed by Deevek Connect Private Limited. "Clozzet" refers to the company that operates and manages the Platform in the cities where services are offered.

Acceptance of terms

These Terms of Use ("Terms") govern your use of the Platform. "Clozzet", "We", "Us" or "Our" refers to the company operating the Platform; "You", "Your" or "User" refers to users of the Platform. We value the trust you place in us and maintain reasonable security standards to protect transactions and your personal information.

Please read these Terms carefully before using the Platform. If you do not agree, you may not use the products and services on the Platform, and we request you to uninstall the App. By using or accessing the Platform, you agree to these Terms and all other policies posted on the Platform (including the cancellation and refund policy and the Privacy Policy), which take effect when you use the Platform. These policies may be amended from time to time; the latest version is always available on the Platform.

By providing your personal information, you consent to Clozzet accessing and using it to fulfil orders, and you confirm that you wish to avail services and supplies through the Platform in accordance with these Terms.

Clozzet may modify these Terms at any time. The "Last updated" date indicates the most recent change. Your continued use of the Platform constitutes acceptance of the updated Terms; if you do not accept the changes, please discontinue use.

The Clozzet service

We agree to provide you with the Clozzet Service: all of the products, features, applications, services, technologies and software we provide to advance our mission of bringing fashion and convenience closer to you. The Service includes:

  • Personalised fashion. We build systems that try to understand your preferences and use that information to help you discover collections, offers, brands and items you may be interested in, based on what you and others do in the app.
  • A positive, inclusive and safe environment. We develop tools and resources to keep your experience positive and secure, and use the information we have, including your data, to protect the integrity of the Platform. In cases of misuse or harmful content we may share relevant information with other companies or law enforcement, as described in our Privacy Policy.
  • Technology to serve a growing community. We organise and analyse data, including through automated systems, to personalise, protect and improve the Service. Your data is used responsibly and within Clozzet's ecosystem.
  • Connecting you with brands, products and services. Using data from Clozzet and third-party partners, we present offers and sponsored content we believe will be relevant to you.
  • Research and innovation. We use information to improve our services and to contribute to the well-being of our community.

Merely a platform. The Clozzet Platform is a venue for users to connect and transact with retailers for the sale or supply of fashion goods and services. Clozzet is not a party to any transaction between users and retailers and is not responsible for the quality, safety, legality or availability of listed products, nor for users' ability to complete purchases or sales. These Terms do not create any partnership, joint venture or other business relationship between Clozzet and any third party.

Returns, cancellations and refunds

Clozzet is a platform for customer-retailer connections. Clozzet acts as an intermediary facilitating transactions between customers and retailers. While we assist with cancellations and refunds, the cost of product returns is borne by the seller. For cancellations, Clozzet refunds the customer. For returns, the process remains a matter between the seller and the customer.

Returns and exchanges. Exchanges for size or fit are offered where the individual store's policy allows, as shown on the product page, and must be requested within the window stated there. You may return a product in your order if a wrong item was delivered, or if the item is substantially damaged or deteriorated at the time of delivery. You agree to provide all required proof, including images of the products with issues. Check the product upon delivery and initiate the return with proof on the Platform, or contact customer care. Returns are not accepted if the product is used, or if the security seal is opened.

Non-returnable items. Certain products are non-returnable for hygiene, customisation or other reasons:

  1. Undergarments and intimate wear, including lingerie, innerwear and socks.
  2. Items marked "Final Sale" or "Non-Returnable" at the time of purchase.
  3. Items that have been used, worn, washed, or are missing original tags and packaging.
  4. Face masks, personal care and other hygiene-sensitive products.

If a non-returnable product is defective or damaged on delivery, report it within 48 hours of receipt with supporting images for resolution at our discretion. Clozzet may decline return requests that do not comply with this policy.

Return requests. Products must be sealed, unused and in original condition, and return requests must be made within 2 days of delivery. In some cases you may be asked to dispose of products for which a refund has been processed.

Cancellations. You may cancel at no charge before Clozzet accepts your order. Once the seller has accepted it, cancellation is not permitted. Clozzet may cancel an order, partially or fully, for reasons such as product unavailability, inventory shortage or force majeure; in that case you will not be charged and any payment will be refunded.

Refunds. Once the return or cancellation is verified and all conditions specified by Clozzet or the seller are met, the refund is initiated immediately to the original payment source or your Clozzet Wallet, as you choose. The time it takes to reflect in your account depends on the payment gateway, payment method or bank used, and is outside Clozzet's control.

Additional conditions may apply and will be communicated through the Platform.

Your commitments

Who can use Clozzet. You must be at least 18 years old; you must not be prohibited from receiving any aspect of the Service under applicable law or be on an applicable denied-party list; and we must not have previously disabled your account for violating the law or our policies.

How you can't use Clozzet. You may not engage in unlawful, misleading, fraudulent or unauthorised activity; violate, or help others violate, these Terms or our policies; interfere with the operation of the Service; impersonate others or provide inaccurate information; create accounts or collect information through automated or unauthorised means; buy, sell or transfer any aspect of your account, or solicit or use others' login credentials; post private or confidential information or infringe anyone's rights, including intellectual property rights; or use a domain name or URL in your username without our written consent. You must provide accurate, up-to-date registration details and may not create an account for someone else or a business without their express permission.

Permissions you give us

Your content. We do not claim ownership of your content. When you share, post or upload content covered by intellectual property rights on or through the Service, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide licence to host, use, distribute, modify, run, copy, publicly perform or display, translate and create derivative works of that content, subject to your privacy and application settings. You can end this licence by deleting your content or account, although content you shared with others may continue to appear until they delete it.

Your username, profile picture and information. You permit us to display your username, profile picture and information about your interactions with accounts, offers and sponsored content, to those who have permission to see that content.

Updates. You agree that we may download and install updates to the Service on your device.

Additional rights we retain

If you select a username or similar identifier, we may change it if necessary, for example if it infringes someone's intellectual property or impersonates another user. We retain all rights to content we own and make available in the Service. You must obtain written permission from Clozzet, or comply with an open-source licence, before modifying, creating derivative works of, decompiling or otherwise extracting source code from our services.

Content removal and account termination

We may remove any content, information, products or services you share if we believe they violate these Terms or our policies, or where required by law. We may also refuse or stop providing part or all of the Service, including disabling or terminating your account, to protect our community or services, and will notify you when appropriate. Deleted content may persist for a limited period in backup copies and remain visible where others have shared it. The sections "Our agreement" and "Who is responsible" survive termination or deletion of your account.

Our agreement and what happens if we disagree

If you use other features or related services, additional terms (for example Payment Terms) become part of our agreement and govern in case of conflict. If any part of this agreement is unenforceable, the rest remains in effect. Any amendment or waiver must be in writing and signed by us; failure to enforce any aspect is not a waiver. We reserve all rights not expressly granted to you.

This agreement does not give rights to any third party. You may not transfer your rights or obligations without our consent. Our rights and obligations may be assigned to others, for example in a merger, acquisition or sale of assets, or by law.

Who is responsible if something happens

The Service is provided "as is", and we cannot guarantee it will be safe, secure or work perfectly at all times. TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

We do not control what people do or say and are not responsible for their, or your, actions, conduct or content, nor for services and features offered by other people or companies, even if accessed through the Service. Our liability is limited as far as the law allows. You agree that we will not be liable for lost profits, revenues, information or data, or for consequential, special, indirect, exemplary, punitive or incidental damages arising out of or related to these Terms, even if we know they are possible, including when we delete your content, information or account.

Clozzet acts as an intermediary and is not liable for product quality, legality or seller performance; seller delays or non-fulfilment; or losses arising from user negligence or misuse of the Platform. Users shall indemnify Clozzet against claims arising from misuse of the Platform, fraud or breach of these Terms.

Delivery, fees and delivery time

Clozzet is a venue, and all deliveries are third-party deliveries. Last-mile delivery is provided upon purchase, during the time periods communicated through the Platform. We show an estimated delivery time for every order but do not guarantee delivery within it, as the exact time may vary with availability of delivery partners, demand, traffic and weather conditions, force majeure events and other factors. You can check the estimated time of arrival in the app before placing an order.

In addition to the delivery fee, Clozzet may charge fees for rain, peak hours, high demand, late-night delivery, packing and handling, convenience or platform fees, small-order fees or other fees, all shown in the "view bill" section before checkout. Clozzet may levy a charge on low-value orders, shown on the bag page, and may modify or waive it at any time.

You are responsible for providing a complete and correct delivery address; we are not responsible for delays caused by incorrect or incomplete addresses. Delivery is made when an appropriate person is available to receive the order. If you ask for a delivery to be left unattended, you release Clozzet from liability for theft, tampering or damage.

For Cash on Delivery orders, payment must be made before the package is opened. If you fail to make complete payment, Clozzet may refuse delivery, treat the order as cancelled and charge delivery or other fees for the cancelled order.

You agree to notify Clozzet of any delivery issue (non-receipt, missing products, signature issues) within 5 days of the alleged delivery. Failure to do so will be deemed successful delivery, and Clozzet disclaims liability for claims made after this period.

User conduct and platform rules

Fraud and bulk orders. Clozzet may cancel orders deemed bulk or fraudulent at any stage, including products ordered for resale, multiple orders of the same product to the same address, bulk quantities, invalid addresses, or misuse of promotional vouchers or technical glitches.

User-generated content. Where the Platform allows comments, photos or videos, you agree to comply with these Terms and the Privacy Policy, not to harass, abuse or violate any user's rights, and to avoid exploitation of others or inappropriate behaviour.

State laws. Products sold on Clozzet are subject to state laws. Where a seller cannot fulfil an order for legal reasons, the seller will refund or credit any advance payment for products that cannot be delivered.

Phone number. To place an order you must provide a valid phone number. By registering it you consent to be contacted by Clozzet about orders, shipments and deliveries via calls and SMS.

Pricing and errors. If an error occurs in pricing or product details due to technical or typographical issues, the seller may cancel the order; Clozzet is not responsible for such errors or cancellations.

Multiple sellers. The same style may be sold by multiple sellers, and the displayed price may not always be the lowest; seller prices are shown on the product page.

Currency. All payments must be made in Indian Rupees.

Transactions and commercial terms. Transactions, pricing, delivery, dispatch and other commercial terms are governed by the agreement between buyer and seller. The payment facility provided by Clozzet is a facilitator only and does not make Clozzet liable for non-delivery, non-receipt, non-payment, damage, breach of warranty or fraud relating to listed products. Clozzet does not verify users' identities and does not guarantee that a buyer or seller will complete a transaction.

Trademark, copyright and restrictions

Clozzet operates the Platform; products are sold by their respective sellers. All content on the Platform, including images, illustrations, audio and video, is protected by copyright, trademark and other intellectual property laws and is provided solely for personal, non-commercial use. You may not copy, reproduce, republish, upload, post, transmit or distribute such material, or modify, commercially use or redistribute it, without prior written consent from the owner.

Disclaimer. You access and transact on the Platform at your own risk and exercise prudent judgment before entering any transaction. Clozzet is not responsible for the actions or inactions of sellers or any breach of warranties by sellers or manufacturers, and makes no warranties regarding the products, including suitability, merchantability or legality. While we strive for accurate pricing and product details, we do not guarantee the absence of errors.

Sellers

Registered sellers may list items in accordance with our policies, which are incorporated into these Terms. Sellers must be legally permitted to sell the listed items and must ensure they do not infringe third-party intellectual property, trade secrets, privacy or publicity rights. Listings must include only accurate descriptions, graphics and pictures; be placed in the correct category; be kept in stock; and truthfully describe the product's condition, with any amounts refunded where the condition differs. The same product may not be listed in multiple categories. Sellers may not use the Platform to advertise or solicit users for sales outside Clozzet. Account verification is based on proof of business submitted per government requirements; Clozzet does not guarantee verification, and disputes about verification or fraudulent listings are the responsibility of the user.

Commercial terms between Clozzet and each seller are set out in the seller's individual partner agreement.

Alteration services

Clozzet may offer alteration services (such as length or waist adjustments) for garments purchased on the Platform. A nominal fee, as determined by Clozzet at the time of the request and inclusive of applicable taxes, may apply to cover pickup, drop-off or tailor visits.

Disputes, feedback and updates

Disputes. For consumers, the laws of your country apply to claims arising from these Terms, and you may resolve disputes in a competent court in your country. In all other cases, disputes will be resolved in the High Court of Gujarat, Ahmedabad.

Unsolicited material. Clozzet appreciates feedback and suggestions but may use them without restriction or obligation to compensate you, and is not obliged to keep them confidential.

Updating these Terms. Clozzet may update these Terms periodically. If changes are made, we will notify you before they take effect; continued use of the Service means you accept the updated Terms.
