Terms of Use for Clozzet Platform
This document is an electronic record published in accordance with the provisions of the Information Technology Act, 2000, and the rules thereunder, and generated by a computer system. It does not require any physical or digital signatures.
- Platform Overview The Platform, www.clozzetindia.com (the “Platform”) and mobile application Clozzet (the “App”) (together referred to as the “Platform”) is owned and managed by Deevek Connects Private Limited. The term “clozzet” or “Clozzet” refers to the company or entity that operates and manages the Platform in the respective cities, where services are offered.
- Acceptance of Terms These terms of use (“Terms”) govern Your use of the Platform. For the purposes of these Terms, Clozzet, “We”, “Us”, or “Our” refers to the company operating the Platform. The terms “You”, “Your”, or “User” refer to the users of the Platform. We value the trust You place in Us, and that’s why We maintain reasonable security standards to protect transactions and Your personal information.
- Consent to Use of Personal Information By providing Your personal information, You consent to Clozzet accessing and using it for the purpose of fulfilling orders. You also agree that You are interested in availing services and supplies through the Platform in accordance with these Terms.
- Modifications to the Terms Clozzet retains the right to modify or amend these Terms at any time. The “Last Updated” date on the Platform will indicate the most recent changes. You can always access the latest version of these Terms on the Platform. Your continued use of the Platform constitutes Your acceptance of the updated Terms. If You do not accept the changes, You should discontinue using the Platform.
- Offering personalized fashion opportunities We understand that people are unique. At clozzet, we aim to strengthen your style and shopping experience by personalizing the way you shop. We build systems that try to understand your fashion preferences and use that information to help you discover, create, and share clothing experiences that matter to you. This includes highlighting curated collections, offers, brands, or items that you might be interested in, and offering ways for you to experience clozzet, based on things you and others do in our app.
- Fostering a positive, inclusive, and safe environment We develop tools and offer resources to make your experience positive, inclusive, and secure. We have dedicated teams that work to combat abuse, harmful behavior, and violations of our Terms and policies. We also use all the information we have, including your data, to ensure the integrity of our platform and keep your experience secure. In cases of misuse or harmful content, we may share relevant information with other companies or law enforcement. Learn more in our Privacy Policy.
- Developing and using technologies to serve our growing community A key part of our service is organizing and analyzing data for a better user experience. We utilize advanced technologies like artificial intelligence and machine learning to personalize, protect, and improve our service at a global scale. Automated systems also help us ensure the functionality and integrity of the clozzet platform.
- Clozzet integrates technology, systems, and data insights to enhance user experience and ensure a consistent, connected shopping journey. Your data is used responsibly and solely within Clozzet’s ecosystem to offer secure and personalized services.
- Connecting you with brands, products, and services you care about Using data from clozzet and third-party partners, we present ads, offers, and sponsored content that we believe will be meaningful to you. Our goal is to ensure that the content you see on clozzet is as relevant and valuable as the other experiences we provide.
- Research and innovation We use information to improve our services and collaborate on research to make our platform better and contribute to the well-being of our community.
- Website/App – Merely a Platform The clozzet Platform/App acts as a venue for users to connect and interact with retailers or other users for the sale or supply of fashion goods or services. Clozzet is not a party to any transaction or agreement between users and is not responsible for the quality, safety, legality, or availability of the products or services listed on the platform. Clozzet is also not responsible for the ability of users to complete purchases or sales. This agreement does not create any partnership, joint venture, or other business relationship between clozzet and any third party.
Returns, Cancellations, and Refunds
- Clozzet is a Platform for Customer-Retailer Connections: Clozzet acts solely as an intermediary platform facilitating transactions between customers and retailers. While we assist in processing cancellations and refunds, the monetary charge for product returns is to be borne by the seller. In case of cancellations, Clozzet will refund the money to the customer. For return orders, Clozzet is not directly liable for the return process as it remains a matter between the seller and the customer
- Returns:
You may return a product in your order under the following conditions:
- A wrong item has been delivered other than what you had ordered.
- The item is substantially damaged or deteriorated in quality at the time of delivery. You agree to provide the clozzet with all the required proof, including but not limited to images of the products with issues.
- You must check the product upon delivery and initiate the return with the required proofs on the platform. You can also contact clozzet’s customer care for assistance.
- Clozzet will not accept returns if the product is used or consumed, either partially or fully, or if the security seal is unsealed.
- Non Returnable Items:
- Undergarments and Intimate Wear – Including but not limited to lingerie, innerwear, and socks, for hygiene reasons.
- Final Sale Items – Any product explicitly marked as “Final Sale” or “Non-Returnable” at the time of purchase.
- Products Without Original Packaging – Any item that has been used, worn, washed, or is missing its original tags and packaging.
- Health & Safety Products – Face masks, personal care items, and other hygiene-sensitive products.
- Return Requests: You may request a return for products purchased from clozzet, provided the products are sealed, unused, and in their original condition. Return requests must be made within 2 days of the product being delivered. Please note that we will not accept any return requests after that. In some cases, you may be asked to dispose of the products for which a refund has been processed.
- Cancellations: You may cancel your order at no charge at any time before clozzet accepts it. Once the order has been accepted by the seller, cancellations are not permitted. clozzet reserves the right to cancel an order (partially or fully) due to reasons such as product unavailability, inventory shortages, or force majeure events. If clozzet cancels an order, you will not be charged, and any payments made will be refunded.
- Refunds: If you choose to cancel or return products, once we have verified the products and any related documentation, the refund amount will be processed within seven business days. Refunds will only be issued when all conditions specified by clozzet or the related seller are met. Refunds will be credited to the original payment source or your Clozzet Wallet, as per your choice. Please note that after initiating a refund, it may take additional time for the refund to appear in your account, depending on your financial institution or payment gateway service provider.
- Additional Conditions: The terms for acceptance of returns, cancellations, and refunds may be subject to reasonable additional conditions and will be communicated to you through push notifications on the clozzet platform or other means as specified by clozzet.
Your Commitments
In return for our commitment to provide the service, we require you to make the following commitments to us:Who Can Use clozzet
We want our service to be open and inclusive, but we also want it to be safe, secure, and in compliance with applicable laws. Therefore, we ask that you agree to the following conditions to be part of the clozzet community:- You must be at least 13 years old or the minimum legal age in your country to use clozzet.
- You must not be prohibited from receiving any aspect of our service under applicable laws or engaging in payments-related services if you are on an applicable denied party listing.
- We must not have previously disabled your account for violation of law or any of our policies.
How You Can’t Use Clozzet
Providing a safe and open service for our community requires that everyone plays their part.- You can’t engage in any unlawful, misleading, fraudulent, or unauthorized activity on the clozzet Platform.
- You can’t violate (or help or encourage others to violate) these Terms or our policies.
- You can’t interfere with or impair the intended operation of the service.
- You can’t impersonate others or provide inaccurate information.
- While you don’t have to disclose your identity on the clozzet, you must provide accurate and up-to-date information, including registration details. You may not impersonate someone else or create an account for someone else or a business unless you have their express permission.
- You can’t attempt to create accounts or access or collect information in unauthorized ways. This includes creating accounts or gathering information through automated methods without our express permission.
- You can’t attempt to buy, sell, or transfer any aspect of your account (including your username) or solicit, collect, or use login credentials or badges of other users.
- You can’t post private or confidential information or do anything that violates someone else’s rights, including intellectual property rights.
- You can’t use a domain name or URL in your username without prior written consent from clozzet.
Permissions You Give to Us
As part of our agreement, you also grant us the permissions necessary to provide the clozzet service.- Ownership and License of Your Content:
- We do not claim ownership of your content, but you grant us a license to use it. Nothing is changing about your rights to your content. When you share, post, or upload content (like photos or videos) that is covered by intellectual property rights on or through the clozzet service, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (subject to your privacy and application settings). You can end this license anytime by deleting your content or account. However, content will continue to appear if you shared it with others and they have not deleted it. For more details on how we use your information and how to control or delete your content, please review the clozzet Privacy Policy.
- Permission to Use Your Username, Profile Picture, and Information:
- You grant us permission to display your username, profile picture, and information about your interactions with accounts, ads, and sponsored content. For example, if you like or engage with a sponsored ad or product, we may show your actions next to the ad or content. This information will be visible to those who have permission to see that content. We will also respect your ad settings.
- Permission for Updates:
- You agree that we can download and install updates to the clozzet service on your device.
Additional Rights We Retain
- Username and Identifier Changes:
- If you select a username or similar identifier for your account, we may change it if necessary (for example, if it infringes someone else’s intellectual property or impersonates another user).
- Intellectual Property Rights:
- If you use content covered by intellectual property rights that we own and make available in our service (for example, images, designs, or sounds), we retain all rights to our content (but not yours).
- Modifying or Extracting Source Code:
- You must obtain written permission from clozzet or adhere to an open-source license if you wish to modify, create derivative works of, decompile, or otherwise attempt to extract source code from our services.
Content Removal and Account Termination
- Content Removal:
- We can remove any content, information, products, or services you share on the service if we believe it violates these Terms of Use, our policies or if we are required by law to do so. We can also refuse to provide or stop providing part or all of the service to you, including disabling or terminating your account, to protect our community or services. This could happen if you violate these Terms or our policies, infringe others’ intellectual property rights, or where required by law. If we take action to disable or terminate your account, we will notify you when appropriate.
- Deleted Content:
- Content that you delete may persist for a limited period in backup copies and will remain visible if others have shared it. The terms in this section and the section “Our Agreement and What Happens if We Disagree” will still apply even after your account is terminated or deleted.
- If you use certain other features or related services, additional terms will be made available and will also become a part of our agreement. For example, if you use payment features, you will be asked to agree to the Payment Terms. If any of those terms conflict with this agreement, those other terms will govern.
- If any aspect of this agreement is unenforceable, the rest will remain in effect.
- Any amendment or waiver to our agreement must be in writing and signed by us. If we fail to enforce any aspect of this agreement, it will not be a waiver.
- We reserve all rights not expressly granted to you.
- This agreement does not give rights to any third parties.
- You cannot transfer your rights or obligations under this agreement without our consent.
- Our rights and obligations can be assigned to others. For example, this could occur if our ownership changes (as in a merger, acquisition, or sale of assets) or by law.
- Our Service is provided “as is,” and we can’t guarantee it will be safe and secure or will work perfectly all the time. TO THE EXTENT PERMITTED BY LAW, WE ALSO DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
- We also don’t control what people and others do or say, and we aren’t responsible for their (or your) actions or conduct (whether online or offline) or content (including unlawful or objectionable content). We also aren’t responsible for services and features offered by other people or companies, even if you access them through our Service.
- Our responsibility for anything that happens on the Service (also called “liability”) is limited as much as the law will allow. If there is an issue with our Service, we can’t know what all the possible impacts might be. You agree that we won’t be responsible (“liable”) for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these Terms, even if we know they are possible. This includes when we delete your content, information, or account.
- Clozzet is merely a venue/platform, and all our deliveries are third-party deliveries. We do not guarantee safe and on-time delivery.
- Last mile delivery services are part of the sale of products purchased by you on the platform. The company will provide third-party delivery of the products upon purchase, during such time periods as communicated to you through the platform. The company endeavors to show the estimated delivery time for every order. However, we do not guarantee delivery within the said time, as the exact delivery time of each order may vary due to various factors such as availability of third-party delivery service providers, demand, traffic and weather conditions, force majeure events, etc. You can check the estimated time of arrival (ETA) on the homepage of the app before placing an order.
- The company reserves the right to charge you a fee for rain, peak hours, high demand, late-night fees, packing handling charges, convenience/platform fees, small cart fees, or any other fees in addition to the delivery fee, which you will see in the “view bill” section before checkout.
- You are responsible for providing a complete and correct delivery address. The company is not responsible for delays caused by incorrect or incomplete addresses.
- The delivery of products will be made when an appropriate person is available to receive the order. If you request to leave a delivery unattended at your address, you disclaim the company from all liabilities related to theft, tampering, contamination, or temperature changes that may affect your items.
- In case of ‘Cash on Delivery (CoD)’ payment, the company reserves the right to refuse delivery if you fail to make the complete payment. The order will be treated as canceled, and the company may charge you a delivery fee or any other fees for the canceled order.
- Verification of accounts will be done based on the proof of business submitted according to your government’s requirements.
- clozzet does not guarantee the verification of companies, and any disputes related to account verification or fraudulent listings are the responsibility of the user.
- For consumers, the laws of your country will apply to any claims arising from these terms. You may resolve disputes in a competent court in your country. In all other cases, disputes will be resolved in the High Court of Gujarat, located at Sarkhej-Gandhinagar Highway, Sola, Ahmedabad, Gujarat 380060.
- Clozzet appreciates feedback or suggestions but may use them without restrictions or obligations to compensate you, and there is no obligation to keep them confidential.
- Clozzet may update the terms periodically. If changes are made, we will notify you before they go into effect. By continuing to use the service, you agree to the updated terms.
- Platform Use Only: Clozzet provides the platform for users to connect and transact. The platform does not assume any direct involvement in the sale of products or services. Any issues regarding the product’s performance, availability, or delays are the responsibility of the seller and buyer. Clozzet does not guarantee stock availability or on-time delivery.
- Pricing and Errors: If an error occurs in the pricing or product details listed on the platform, due to technical or typographical issues, the seller may cancel the order. Clozzet is not responsible for such errors or cancellations.
- Fraud Orders: Clozzet may cancel orders deemed to be “Bulk Orders” or “Fraud Orders” at any stage. Such orders may include:
- Products ordered for resale or not for personal use.
- Multiple orders for the same product at the same address.
- Bulk quantities of the same product.
- Invalid address or fraudulent order placement.
- Misuse of promotional vouchers or technological glitches to place orders.
- User-Generated Content:
Clozzet allows users to engage with content related to fashion, including viewing and posting user-generated content (UGC) such as comments, videos, and photos. By accessing, viewing, or posting on the platform, you:
- Agree to comply with these Terms of Service and our Privacy Policies.
- Must not harass, abuse, or violate any user’s rights.
- Should avoid any form of exploitation of others or inappropriate behavior.
- State Laws and Delivery The products sold on Clozzet are subject to various state laws, and in cases where sellers are unable to fulfill orders due to such legal implications, the seller will either return or issue a credit for any advance payment received for products that cannot be delivered.
- Phone Number Registration and Communication To place an order on the platform, you must provide a valid phone number. By registering your phone number with us, you consent to be contacted by Clozzet for any updates related to orders, shipments, or deliveries via phone calls and/or SMS notifications.
- Liability Disclaimer Clozzet acts as an intermediary platform and is not liable for:
- Product quality, legality, or seller performance.
- Seller delays or non-fulfillment.
- Any losses arising due to user negligence or misuse of the platform. Users shall indemnify Clozzet from any claims arising from their misuse of the platform, fraud, or breach of these Terms..
- Currency All payments for purchases or services on Clozzet must be made in Indian Rupees (INR), which is the only currency accepted in the Republic of India. We will not facilitate transactions in any other currency.
- Transactions and Commercial Terms Transactions, pricing, delivery, dispatch, and other commercial terms are governed by the principal agreement between the buyer and the seller. The payment facility provided by Clozzet is a facilitator and does not make Clozzet liable for non-delivery, non-receipt, non-payment, damage, breach of warranty, or fraud relating to the products or services listed on the platform.
- Clozzet is not responsible for the identity verification of users, and does not guarantee that a buyer or seller will complete a transaction.
E-Platform for Communication
By using the Clozzet platform, you acknowledge and agree that Clozzet is an online marketplace enabling you to purchase products listed on the platform at the prices indicated. Clozzet acts solely as a facilitator and cannot be considered a party to, nor control any, transactions made through the platform.Trademark, Copyright, and Restrictions
Clozzet controls and operates the platform, with products being sold by respective sellers. All content on the platform, including images, illustrations, audio clips, and video clips, is protected by copyright, trademarks, and other intellectual property laws. The material on Clozzet is provided solely for personal, non-commercial use. You may not copy, reproduce, republish, upload, post, transmit, or distribute such material in any form, including email or electronic media, directly or indirectly, unless expressly authorized by Clozzet. Modification, commercial use, or redistribution of any content is prohibited without prior written consent from the owner.Disclaimer By using the Clozzet platform, you acknowledge that you are accessing and transacting on your own risk and exercising prudent judgment before entering any transactions. Clozzet shall not be held responsible for any actions or inactions of the sellers or any breach of warranties or conditions by the sellers or manufacturers of the products listed. Clozzet expressly disclaims responsibility and liability regarding the quality, accuracy, reliability, and timeliness of the products or content listed. We make no warranties regarding the products, including their suitability, merchantability, or legality. While we strive to ensure accurate pricing and product details, we do not guarantee the absence of errors on the platform.Delivery Related You agree to notify Clozzet regarding any issues with delivery (e.g., non-receipt, missing products, or signature verification issues) within 5 days from the date of the alleged delivery. Failure to notify Clozzet within this time period will be deemed as a successful delivery. Clozzet disclaims any liability for non-delivery or non-receipt claims made after this period.Cash on delivery For Cash on Delivery (COD) orders, payment must be made before the package is opened.. In the case of COD orders, you will receive an immediate refund. For prepaid orders, the refund will be processed back to the source.Multiple Sellers Products of the same style may be sold by multiple sellers on the platform, and the displayed price may not always reflect the lowest price for that style. Once you land on a product display page, you will have access to all seller prices for that particular style.Charges Clozzet may levy a charge on low-value orders as outlined in the FAQ section of the platform. The fee will be specified on the shopping bag page. This fee applies to the overall order value, and Clozzet reserves the right to modify or waive this fee at any time. Charges will be quoted in Indian Rupees. You are responsible for ensuring compliance with all applicable laws when making payments to Clozzet. Seller Side :- Maintaining inventory
- Product Information Accuracy:
- Advertising and Solicitation: You shall not use the platform to advertise or solicit other users for the purchase or sale of products or services outside of those listed on Clozzet.
- Seller Eligibility and Responsibilities
As a registered seller, you are allowed to list items for sale on the Clozzet platform in accordance with our policies, which are incorporated by reference into this Terms of Use. You must be legally permitted to sell the listed items and ensure that they do not infringe on intellectual property rights, trade secrets, privacy, or publicity rights of third parties. Your listings must adhere to the following:
- Only include accurate text descriptions, graphics, and pictures that represent the listed items.
- List items in the correct category on the platform.
- Keep listed items in stock to ensure successful fulfillment of sales.
- Provide truthful descriptions about the product’s condition. If the product’s condition differs from the description, you agree to refund any amounts received for such a product.
- You may not list the same product in multiple quantities across different categories. Clozzet reserves the right to delete any multiple listings of the same product from various categories.
